Terms and Conditions of Sale

(Contract of Sale)

 

Please read and accept the following terms and contract of sale to complete your purchase.

By completing the purchase of applicable products or services from us here at www.visionplay.co.uk you hereby agree to the following terms and conditions as a contract of sale between us ‘Visionplay ltd’ or ‘the seller’ and you ‘the customer’ or ‘the buyer’.

 

Wherein:

 

  1. The buyer agrees that buying any light guns on our website through the custom made to order service (as in light guns that we sell which are not currently in stock for immediate dispatch or previously traded in by a customer as a part exchange), means that you are requesting the complete ‘by hand’ manufacture of hand customised electronic goods, where the item is not made up from ‘off the shelf’ items but individual electronic components that are wired and soldered together by hand into larger unique (not off the shelf) components before being assembled into the final product.  All internal components are sourced, bought, paid for, engineered and assembled by hand individually to make this product for the buyer on a per order basis at their given specifications and pricing from what we are able to provide.

 

  1. The buyer accepts that by ordering items as those defined in these Terms and Conditions in the above Section 1 that such items are not eligible for; a return, a refund or cancellation of a processed order once the manufacturing process has been approved.  For reasons as defined in Section 1 of these Terms, Consumer Contracts Regulations (Distance Selling) and 14 days right to return or cancellation for a refund within 14 days of receipt does not apply to these items. By completing a purchase of any these (Section 1) items you unequivocally agree to these terms of sale and will abide by them after placing your order. You also agree not to try and force PayPal payment reversals to circumvent this contract by fraudulent means, or making false claims under PayPal’s own ‘Buyer Protection Policy’ to circumvent this policy wherein PayPal does not apply this policy to custom-made items.

 

  1. All other items (except for digital art, marquees and custom vinyl prints) are covered under standard consumer laws for returns in the United Kingdom only.  Whilst we honour these laws and act within them accordingly we always have the right to refuse service to any customers in future. If a customer abuses our returns process with too many returns for ‘changing their mind’ or other relentless and unreasonable reasons, they will be deemed as a ‘financial risk’ to our business and banned from using our website and their IP address, name, mailing address and email address will be permanently blacklisted to prevent them from using our website in future.  We are here to provide a fair service to fair people and we always have the right to refuse service or cancel orders and refund them for any reason we deem necessary. We will do this when necessary to protect our business from potential bad actors, fraud and scams.

 

  1. The buyer accepts that in regards to delivery of items described in Section 1, they are not available for immediate dispatch and will require a manufacturing ‘on-demand’ period followed by an export period of 14 to 22 days. It is therefore expected for delivery to take up to 30 days from the date of payment for the United Kingdom, with overseas destinations expected take additional transit time depending on the region and available overseas shipping services. You accept that by placing an order for these items you will be expecting to wait up to 30 days for these items to be delivered to you within the UK, but for overseas buyers we cannot guarantee a set timeframe unless you specifically opt for an express global shipping option. Sometimes we may need to request additional shipping costs before processing your order if these costs are not covered in your initial payment amount or if service prices have increased without our knowledge. At this point you will have to right to cancel for a full refund before the order is processed if you do not agree with these additional charges. We will only post items to addresses verified by the payment method used and within the regions we will ship to.  Any non-verified addresses or unsupported geographical locations used for shipping will require payment by direct bank transfer or to our bank account via Western Union or Moneygram only, as PayPal will not be accepted for those orders. Please see our FAQ sections for where we will and will not ship our products and how to use alternate payment methods for international transactions.

 

  1. For overseas (non UK) buyers, the buyer accepts that when ordering from overseas (Non UK) locations that import taxes may be incurred based on the value of items combined with the cost of shipping and insurance.  We ‘the seller’ will not be held responsible for these charges as they are completely out of our hands. We cannot declare false values on items due for international shipping as this will pose the risk of a reduced compensation value in the event of a ‘lost in transit’ shipment if ‘the seller’ is liable to replace the lost insured item/s.  You understand, agree and accept by your own choices selected at checkout, that if you select an ‘insured’ shipping method you will be covered for any potential losses in transit. However if you select an ‘uninsured’ shipping method to save on shipping costs, then you will NOT be covered for any losses in transit.  We the seller will not be held responsible for the financial losses incurred for the loss of uninsured packages beyond the default coverage for that service and the buyer must choose (of their own free will) at checkout whether to accept these losses or pay the insurance premium element to insure against any losses to protect themselves.  Any insured items will be replaced and re-shipped free of charge (but subject to the standard manufacturing and delivery timeframes once again in addition to the return to manufacturer transit times).

 

  1. For Replacements and Warranty.  If an item has a mechanical failure or fails to function as intended by design within 90 days of receipt, you ‘the buyer’ are entitled to a full repair or replacement only if;

 

  • You cover the cost of the return shipping direct to the manufacturer at their overseas location.

  • The failure is not as a result of physical or accidental damage you have caused to the item (dropping, drowning, spillages etc...).

  • The item has otherwise arrived as non-working condition and you have reported it within 48 hours of receipt of the goods to ‘the seller’.

 

You are not covered if;

 

  • There are signs of physical or accidental damage to the item or the item is not in a condition that closely resembles its ‘as sold’ condition (cracks, heavy scuffs, excess internal moisture etc…).

  • You have physically/mechanically modified the item in any way

  • The issue has occurred after 90 days of receipt or is claimed for not working on arrival more than 48 hours after delivery.

 

The initial cost of returning the item to the manufacturer will be re-credited to ‘the buyer’ in the form a credit voucher redeemable in our online store against any future purchase and will never expire, but this cost will not be refunded in cash or by any other means.  To request a repair simply contact us and we will make all the arrangements for you. You accept and agree by doing so that any repairs or replacements will be subject to the standard waiting period as previously defined herein with no exceptions.  If you return an item that is not eligible for repair or replacement under these terms, then you will need to pay for the items to be returned to you or pay a repair fee and a return shipping fee. So please let us know honestly what the problem is to avoid any excess costs as a result of a misleading return. We may also be able to offer an out of warranty repair to the buyer at cost (parts, labour and return shipping), so to be eligible for this the buyer must agree to always be honest with us about the nature and cause of any faults and we ‘the seller’ agree to always do our best to help you as a highly valued customer.

 

  1. Your data and how it is used.  We only store your data in our customer database for the purposes of taxes, accounting and fulfilling your orders. We do not share your data with third parties other than to fulfill your order (like shipping companies and where otherwise legally required). We do not sell your data and your details are kept completely private and secure and cannot be accessed by third parties outside our company. You have the right to the removal of your account and data upon request by contacting us directly, however please note that doing this will void any active warranties where we will no longer be able to verify them against your past order details.  By using our website you agree to let us store and use your details as entered by you (the buyer) and saved in your online account with us, solely for the purposes of providing you with access to our products and services. We do not use third party cookie trackers that monitor your activity outside our website.
